Abstract:

This article explains the significance and current situation of trade secrets protection and sorts out the legal system for protecting trade secrets, and then summarizes the factors for determining the elements of trade secrets and the trial process for trade secret cases. Finally, from the perspective of the court's reasoning, the following countermeasures are proposed for companies to protect trade secrets: retaining documents that can prove the rights holder, paying attention to identifying the essence of trade secrets, improving the protection measures for trade secrets, and taking multiple measures to protect their own rights and interests.
