Abstract: Survey and design products are works regulated by Copyright Law, and the judgement of their originality needs relative professional and technical knowledge. The amount of indemnity against copyright infringement should be calculated based on the income obtained by illegally using the works. Combined with the judicial precedent of Shanghai Intellectual Property Court about the copyright case of engineering design drawings, clarifying the copyright related concepts and tort liability in engineering construction field is particularly important for engineering companies to enhance copyright protection and sustainable development.
